UnidosUS Responds to Supreme Court Order on Mail-In Voting Restrictions

WASHINGTON — Today, the Supreme Court lifted a lower court’s injunction blocking part of President Trump’s executive order restricting mail-in voting ahead of the November 2026 elections. A separate, nationwide injunction blocking the U.S. Postal Service from implementing the order’s mail-ballot mandates remains in place, meaning the core of the executive order is still blocked for now, even as today’s ruling clears the way for other parts of it to move forward. The president’s executive order, if ultimately deemed lawful, would give the federal government unprecedented control over which voters can receive a mail-in ballot, threatening access for millions of eligible voters across the country.

Janet Murguía, president and CEO of UnidosUS, the nation’s largest Hispanic civil rights and advocacy organization, issued the following statement in response:

“Today’s order does not resolve the fundamental question at stake: whether the president has the authority to unilaterally override states’ constitutional power to administer their own elections. Concerningly, the Supreme Court has once again declined, in this moment, to say whether the administration’s actions are consistent with the Constitution.

“Mail-in voting is how millions of Americans exercise their constitutional right. Members of our military serving overseas depend on mail-in voting to participate in our democracy. So do Latino working-class voters who cannot take time off work, who lack reliable transportation, or who have health conditions that make in-person voting difficult. For all of them, access to mail-in ballots is not a convenience; it is essential.

“This ruling does not affect any voter’s ability to cast a mail ballot. But this fight is not over. UnidosUS will continue to push back against this unconstitutional power grab, standing alongside the states and voting rights groups fighting it in the courts. We will not allow uncertainty from the courts to become uncertainty for voters. We will continue to train trusted local partners on the ground, connecting voters to legal support and equipping our community with the resources they need to vote with confidence in November.”
